Terms of Service

1. Acceptance of Terms

By accessing or using KindLearn (kindlearn.ai), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the service.

These Terms are a legal agreement between you and KCF LLC (Kindness Community Foundation), the company that operates KindLearn.

2. Eligibility

KindLearn is available to all users. Users under the age of 13 (or the applicable age of digital consent in their country) may only use KindLearn's Kids Zone through a parent or guardian's account, with that adult's consent. By creating an account, you confirm that either (a) you are 13 or older, or (b) you are a parent or guardian enabling Kids Zone access for a child in your care.

3. The Service

KindLearn provides a free, AI-assisted language learning platform including:

• Daily lessons across 13 languages • A 30-day language challenge • AI conversation practice • A Kids Zone for ages 4–12 • Community features (discussion groups, study circles, learning feed) • A Creator Hub for publishing educational courses • Gamification features (XP, streaks, badges)

KindLearn is provided free of charge. We reserve the right to introduce optional paid features in the future; we will provide clear notice before doing so.

4. Account Registration

To access personalised features, you must create an account using your email address. You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us immediately at contact@kindnesscommunityfoundation.com if you believe your account has been compromised.

You may not create accounts on behalf of others, use false information to register, or create multiple accounts to circumvent restrictions.

5. Acceptable Use

You agree not to:

• Post or share content that is illegal, harmful, hateful, abusive, harassing, defamatory, or obscene • Use the platform to spam, phish, or distribute malware • Scrape, crawl, or systematically download content from KindLearn without written permission • Attempt to reverse-engineer, decompile, or interfere with the platform • Use the Kids Zone to contact children for any purpose outside of the educational features provided • Misrepresent your identity or credentials in the Creator Hub • Violate any applicable law or regulation

We reserve the right to suspend or terminate accounts that violate these rules.

6. Creator Hub

If you publish content through the Creator Hub, you grant KindLearn a worldwide, non-exclusive, royalty-free licence to display, distribute, and promote your content on the platform. You retain ownership of your content.

You are solely responsible for ensuring your course content does not infringe third-party intellectual property rights, violate any laws, or contain misleading information.

We reserve the right to remove content that violates our policies.

7. Intellectual Property

All KindLearn content — including lesson materials, UI design, logos, graphics, and AI-generated exercises — is owned by KCF LLC or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without written permission.

User-generated content (forum posts, course materials you publish) remains your intellectual property, subject to the licence granted in Section 6.

8. Disclaimer of Warranties

KindLearn is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or completely secure. We make no guarantees about specific learning outcomes or language proficiency results.

Language learning outcomes depend on individual effort, consistency, and many factors outside our control.

9. Limitation of Liability

To the maximum extent permitted by applicable law, KCF LLC and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of KindLearn, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of the service will not exceed USD $50 (or the equivalent in your local currency).

Some jurisdictions do not allow limitation of liability for consumer protection reasons; in those cases, the above limitation applies to the fullest extent permitted.

10. Termination

You may close your account at any time by emailing contact@kindnesscommunityfoundation.com. We will delete your account and personal data within 30 days.

We may suspend or terminate your account if you violate these Terms, if required by law, or if we discontinue the service. We will give you reasonable notice where possible.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify registered users by email or in-app notice at least 14 days before the changes take effect. Continued use of KindLearn after the effective date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute that cannot be resolved amicably will be subject to the exclusive jurisdiction of the courts of Delaware.

If you are a consumer in the EU or UK, you retain the benefit of mandatory consumer protection provisions under the laws of your country of residence.
